urgent! need your advice on my son's registration as BC

Dear all,

I do need your advice and help on my son's application.

My son came to UK with me in Jan 2013 as visitor, he doesn't need visa to enter uk as taiwanese. Now after one month I want to register him as BC. I am not sure he will be allowed to do so, I also emailed home office enquirying this. However I have not received any reply from them. Please see his details below:

My son was born in 2010 in China , outside UK ( 2 year and 9 months old now)
Nationality: Taiwanese
Place of birth: China
My son used to live in China and Taiwan, he came to uk with me straight away after his father and I got divorce in Dec 2010. I have his Sole custody this states at divorce Reconciliation Statement.

I naturalised to British citizen in 2011 after my son was born. Working full time in London.

Can I use MN1(SECTION 3.1) to apply for his BC registration?
He only came here for a month as visitor, how can i find one referee like GP, school/nursery teacher?

Please do help me with it.

It is unlikely your son could register as BC without a proper immigration status in the UK. He should have a settlement visa. You may wish to consult with a immigration lawyer about your options.

Jambo, thanks so much for your reply. I did consult some immigration lawyers, however some said yes , some said no, it is very confusing.

anyone has the similar situation? how do you deal with it?

British Citizenship application will be Subject to discretion (3(1)).
