british pass port for son

hello, i can see this place is very useful. may be someone can help me with my questions. i came here on spouse visa in jan 2009, got ilr and then british citizenship. my son who was born on 12.12.2009 in uk when i was in spouse visa status. i want apply british passport for my son with out using my husband's passport for some reasons. can i apply directly for my son's british passport at my own because i am british? or do i have to go through any other immigration process. something like naturalization?

Was your husband British when the child was born? Then the child is British from birth. You don't need your husband passport but you do need your husband passport number for the application (to show that one parent was British when the child was born).

Actually, if you were on a spouse visa, then this suggests that your husband was either settled or British. Therefore, child is automatically British.

thank u so much jumbo and vinny for your reply. yes my husband was british when child was born. but the problem is my husband now has a criminal conviction. if i apply for child's passport would it be a problem ? would they go through my husband's criminal record when they will decide my son's passport application?

No.
The child is British from birth. His father's criminal record has nothing to do with his right as a British citizen to have a passport.
