Questions 1.3 EEA Family Member

hi guys how should i fill the question 1.3
i am an non EU EEA Family member and have automatic PR status after married to EEA polish national from 15 dec 2007 SO MY AUTOMATIC PR START FROM 15 DEC 2012
i don't want TO apply EEA4 to conferm my PR STATUS
1.3 Please say when you were given indefinite leave to enter/remain in the UK (not necessary if you are a Commonwealth
citizen with right of abode in the United Kingdom). If you are an EEA
national, a Swiss national or a family member of an EEA or Swiss
national you should read pages 8-10 of the Booklet AN

Reading your other posts, you should also be aware that applying directly for BC won't save you from providing the same evidence which is required for EEA4 (partner ID, proof of treaty rights etc). You are basically doing a two stage application - proving first you have PR (by providing similar evidence to EEA4 application) and then applying for BC.

why do i need to sent my partner ID for i can show all the evidences of my treaty rights
do I must have to sent her ID card original or photo copy
please advice

Because your right to PR is derived from your spouse having exercised treaty rights and resided in the UK for 5 years. As you do not have a PR confirmation you will need to provide evidence of your spouse's identity and activity in the UK for 5 years.

You, as a non EEA national, don't exercise treaty rights (even if you work). Only EEA national do so. You will need to provide proof of the EEA national ID. It is not mandatory as they have seen her ID for the EEA2. I suggest you explain on the form (on page 13) why you haven't been able to provide the ID and that they should be able to confirm the ID from your RC application. Otherwise it might delay your application.

Depends on the proof you are providing with the application. If you only provide PR card (over 12 months) I would use that. If you provide evidence PR was obtained earliert, then that date. The important part is that the date would be more than 12 months before your application (if not married/CP to a BC).

my daughter just born we got British bird certificate , i got IRL these year and my wife is Slovakian passeport , please can u inform me what i need to apply for british passport for my daughter
