Dear All,

I need your guidance in applying for registration of British Citizenship for my child who will turn one year old soon.

Facts -
*Parents are on Tier 1 (Gen) at the moment and due for ILR on 13th June 2013.
*Post 13th June 2013, we would like to register our child (who would be then exactly 1 year old) as British Citizen using form MN1.
*Child was born in UK in June 2012 and since then has never left UK, hence we do not have any citizenship, passport or nationality document for our baby.
*A UK Birth certificate is all that we have.

Query
1) After reading the guidance note for MN1 and assessing the form the section 1.3 (Date ILR was granted to the child) and 1.9 (Present Nationality) is worrying me. I do not know if we qualify to apply under Section 1.3 of British Nationality Act
2) MN1 guidance note says that if a child does not have any nationality then they should apply using form S2 or S3.

Please guide what needs to be done in this case ?

You will be fine.

Q1.3 asks "If and when" - It is not relevant to your son. just leave blank.

The HO don't ask you to provide documents to prove the nationality you put in Q1.9. Not having a passport doesn't mean you are not a national of a country. Normally a child would get his parents nationality. It's rare that a child is stateless.

Many thanks Jambo. Makes sense. Just called the NCS service and they said the same thing. I should apply on basis of MN1, but they were stressing more on why I should come to them and pay £70 for the whole application process

If you don't have any travel plans, you can make a postal application. The MN1 form is quite simple and no much evidence is required. Decisions are normally done in 1-2 months.

£70 for a child application is a bit on the high side. You should shop around (you can use any NCS you wish. Doesn't need to be local).
