Baby's citizenship - born before ILR

Hi,

My daughter was born on the 1st of June, 2012. My wife and I were granted ILR on the 1st of Feb, 2013. Is my daughter eligible for naturalization? I have read conflicting opinions online. If she is then which form should I use for application?

Where was she born? In the UK or abroad?

Registration for children is form MN1 but depending on where she was born depends under which section of the BC act you have to apply.

i.e. section 1(3) - entitlement (born in UK) or section 3(1) - at discretion (born abroad) and parents applying for BC at same time

She was born in the UK. We do have the birth certificates and everything.

Then it is form MN1 and it is an application under Section 1(3)

Thank you guys. Just one final question.

My daughter doesn't have an ILR because when my wife and I got our ILR we knew that she can apply directly for naturalization. Given this situation when my wife and I apply for our naturalization in Feb 2014, can our daughter apply with us (without the ILR)?

The child does not need to be settled (have ILR) in order to register as British under section 1(3). The child is registered as British not naturalised and under section 1(3) it is entitlement to do so.

Help to filling MN1 form

Hi All,
I need Help Please.
Please correct me if i am wrong.

1. To my understanding to register a child who was born in UK and under 18, one of the parent should be in ILR. Is that correct?

My case
1 . I got recently 10 years ILR
2. My wife is in Tier 1 General Visa till Sep 2013.
3. We have a 2.5 year old kid who was born here.

Can i register my kid as a British citizen using MN1.

Yes under section 1(3) of the British Nationality Act.

If your daughter was born in the UK then you can 'Register' your daughter as a British citizen. The form to use is MN1.
