Son's UK citizenship while applying for parents ILR

Hi,

I am applying for ILR for myself and my wife next month 26th Aug. Our 2.5 yrs old son is born in UK and currently possesses Indian Passport. He also has Biomentric Residence permit (Dependent BRP) which is valid till 19th Sep 2013. As I understand that after we get our ILR our son is eligible for direct UK citizen, I wanted to check if I send my and my wife application of ILR by post which usually takes up to 6 months to get ILR, what will be status of my son whose BRP is valid only till 19th Sep? Will he be eligible to stay in UK? Can we apply for his UK citizenship after we get my ILR (lets assume in Nov/Dec)?

Appreciate any quick help?

Technically your son would become overstayer but this status has no affect on his application for registration as BC.

Does this mean i can apply by post and wait for my ILR for 5-6 months and then later I can apply for my Son's British Citizenship (even though his residence permit ending on 19th Sep)?

As long as you don't plan to leave the UK (which I guess you won't as the HO would have your passports, he will be fine.
