Absences 485 days in 5 years, Is it okay to apply now?

Absences 485 days in 5 years, Is it okay to apply now?

Hi All,

I want to apply for my wife's Naturalisation, She was away for 485 days in past 5 years, but under 90 days in last year. Is it okay to apply now and wait for some time.

They have discretion to disregard upto 480 days in 5years if you can provide a legitimate reason(compassionate).

In this instance 485 days is above that limit and it is better to wait and apply. Having said that 28th October there is a change in KOLL. Check if you can apply on 24th Of October which will hive of a valuable 40 days from the absences and compare the conditions
>been resident in the UK for at least five years (this is known as the residential qualifying period)
>been present in the UK five years before the date of your application(24th October 2008)
>not spent more than 450 days outside the UK during the five-year period; and (This will come down to 435days)
>not spent more than 90 days outside the UK in the last 12 months of the five-year period and
>not been in breach of the Immigration Rules at any stage during the five-year period.
