Nationality criteria

Hi guys,
A friend of mine has recently been granted ILR along with his partner and 4 children(1 UK born) based on 5 years of WP and tier 2 General.
He had applied through a soliciter. After they had their ILR aproved, his soliciter advised him that he can apply for nationality in few weeks as he has already been in UK for 5 years.
He is not european national so as far I understand, he'll have to wait another 12 months before he can apply. He can register his UK born daughter as BC though. I have asked him to ask his soliciter the reason why he thinks they can apply now.
Am I right in thinking that he has to wait for 12 months or is there any way he can apply for BC now?
