Naturalisation "residential qualification period" thru 5year

Hi All,

My question is regarding the residency requirement for naturalisation. In order to qualify under the 5 year rule, can we calculate the residential qualification period based on any legal visa categories, including student visa (assuming all the other criteria are met)?

My situation is specifically as follows: 2 year-student + 2 year PBS-Dependent (Tier 2) + 1-year ILR. I cannot apply through 3-year route, because my spouse is not British citizen yet. So, my conclusion is: since I have lived in the UK for a minimum of 5 years (regardless of the immigration status / visa type), I can apply through 5 year-rule. Am I right?

Correct. Any legal stay (even as a visitor).
