Hi Guru,
Many thanks to all the members of this forum, I highly appreciate you help for my PR last year June. I know it is bit early but want to get rid of confusions and sort out the issues in Advance. I am from India and I have been living in this country since 2006 due to some complications of absenteeism I got PR for me and my family last year June only, that time my daughter was under 18 but now she has just crossed 18. My understanding for the rule of naturalization as follows and I need your help for query below:
1) As per naturalization rule a person has to be physically present at the beginning of 1st year of last 5 year period, for eg. If home office receives my application on 05 Aug 2014 for naturalization then I must be present in UK on 06 Aug 2009.
Does the same rule apply for my wife and my daughter who is now 18 years old?
In case my wife can not apply for 5th year presence rule then can my daughter apply along with me? She (18+) is in full time education?
I have my son as well who is 9 years old. My family also came to UK in 2006 on work permit dependent visa but in 2008 switched over to Dependent Tier 1 (G). They have been away from UK since Jan 2009 till May 2010 and my Wife and my daughter will not be able to fulfil 5th year day presence rule, But I hope I can apply for naturalization for my son along with me under minor category.
2) Should not be 90 days away in last 12 months and not more than 450 days in total away from UK during last 5 years period - We all satisfies this condition so no issue for total absenteeism.
3) If I go through passport checking services then what would be the day when home office receives the application?
This is because I had also long absenteeism in 2009 from Jun to Nov but I was physically present for 4 days in UK during Aug and hence planning to apply in Aug.
I believe the presence includes the day when you left the country and return back. i.e. the day when you take flight and return by flight. Is this correct?
5) Which form should I use in case I would be applying along with my wife and daughter, will it be family form or individual AN form for each.
Does my daughter need to show any additional proof apart from education?
6) My daughter has completed her GCSE exams in UK and currently doing A level. Does she also need to get certificate for B1 english language and life in UK test ?
Really appreciate your help and response.
Thanks
