MN1 for Child born in UK

Hi,
I wish to apply MN1 for my son who was born in UK but as I haven't got ILR yet so we couldn't apply for MN1 at that time.
We had to travel last year so we got his Tier 1 Dependant visa which is due to expire on 26th March 2014.

My question is as there is no way I can send my ILR application and my son's MN1 together as each one has to be posted on different address but if I wait for my ILR to be approved then my son's visa would be expired.

I'm confused, can someone please help, what should I do?

His MN1 will not be approved as you have to send proof of your ILR status with his application.

It does not matter if his visa expires, unless you have travel plans, as he is entitled to register as British citizen and would not be considered an overstayer as born in the UK.

If you apply for ILR in person, you can then apply for MN1 when you receive your ILR BRP.

Hi,

I have been following this forum for few years now and have had a lot of benefits from the experiences and advice coming from members on the forum. I am actually in need of some help and advice for my ILR which is due in May 2014. I would really appreciate if I could please get some suggestions on the following:

1) I got my and wife's Tier-1 extension in June 2012 and my child was born in Dec 2012. I did not get a dependant visa for him as there were no plans for him to travel outside UK. Do I need to include him in my ILR application, or should I get mine and my wife's ILR done, withOut including him as dependant and then apply for child's MN1 after our ILR ?

Yes, this is exactly I'm going to do it. You don't need to apply for ILR for your son as he is born here unless you have plans to travel.

So once you get your ILR, you can send his application for MN1.
