ILR dependent to AN naturalisation

Dear Experts

I hope few senior members can help me out for 1 question regarding BC for AN naturlisation process.

My wife came to UK as Tier 1 (G) dependent in March 2011 and She got ILR in March 2013 based on her 2 years residential period as dependent and I also got the ILR based on 5 year residential period(WP+Tier1) on same day.

After March 2014 we will complete 1 year residential period using ILR visa.

Can she apply for AN naturalization for BC based on her total 3 year residential period?

I read few posts saying one should have stayed at least 5 years to qualify for BC?

It would be better for your to apply first and once you are approved and have attended the ceremony, your wife can apply as it is only at that point that she will be a spouse of BC.

Not many people have had success making joint applications when the spouse has only 3 years residence.

You could ask for her application to be processed and decided after yours, but it is risky and the =/- £200 saving of the joint application fee is really not worth it.

Sorry Initially I thought, ILR dependent can apply for BC if they have completed 1 year in ILR + 2 years as Tier 1 dependent.

Yes, but only once you are British as until then ILR dependent is not a spouse of BC. It is only a spouse of British Citizen that can benefit from 3 years residence. All other applicants should have 5 years residence.

Even if you apply together (to save all of a £200), your dependents application will only be considered after yours, so it will still take longer than usual and you would have to specifically request them to consider the application after yours is decided. This route is generally not recommended to forum members as a it has a high chance of refusal and loss of fee for your dependent because of failing to meet the 5 year residence requirement.

Also, just remember that it is not ILR dependent. Once a person has ILR, they are no longer dependent on the main application.

For naturalisation, there is no 'dependent' category. Each applicant needs to meet the requirements on their own.
