Dear All,
Need some help please.

I am on Tier 1 Visa valid until July 2015. I am eligible for ILR in June 2014 and will be applying then in PEO.
We have travel plan in July 2014.

I have two questions -

1) Child 1 - born in UK in 2010 with indian passport and dependent visa :
(a) Can she travel to India and return to the UK on this PBS dependent visa
(b) or Should I include her for ILR with our application OR
(c) or should I apply her british passport after our ILR (directly apply for british passport or register first using MN1 form). How long will this take ? Do I need to surrender her indian passport/visa first or later.

2) Child 2 - born in Uk in 2014, no passport, visa yet :
Can I directly apply for British passport after our ILR or register first (using MN1 form)

Neither children are automatically British. Therefore, both are ineligible for British passports until they are granted registrations as British citizens.

I will do the British citizen registrations and then apply British passport for both children after our return from India in July.

For now, I will include child 2 with our ILR applicatoion and child 1 (as you suggested) is anyway OK to travel on current PBS dependent visa.

By the way, is this written somehere in 'Immegration rules' / elsehwere on ukba site also - that 'Child PBS Dependent Visa' remains valid after main applicant changes status ?
