Naturalisation and Husband will work abroad

Hi,

I am married to BC and I have ILR and I will apply for Naturalisation on Feb 2015. The question is my husband received an offer to work abroad and he would like to accept it but I would like to know if this will cause a problem in the future when I apply for my naturalisation. The plan is he will stay abroad and I will stay in UK and then I will use my 90 days absence to visit him. Any thoughts.
Your help would be greatly appreciated.

You are allowed to be absent for 90 days in the final year. Anything above that and you will have to apply for discretion as I had to.

Is there any specific requirements by UKBA that my husband should live with me in UK before applying for my Naturalisation?

I remember there was a requirement for spouse and husband to live in uk in order to apply for ILR , so i am not sure if it is the same for naturalisation.

There is no requirement for your BC to live in UK. If you will be using NCS you will just need to present your spouses passport as well as marriage certificate and have in mind that you need to have been present in UK 3 years ago on the day you apply for naturalization.
If you are applying yourself without NCS you will have to copy all pages of his passport.

Thanks milan for your advice.

So, Can I give them copy of his passport if I applied using NCS. In terms of his working documents , shall I submit his foreign payslips and foreign bank statements as a main source of our income. I am also part time employed and in maternity leave at the moment.

As far as I know nothing from him apart from his passport is required as you are applying. If you are self employed you need to enclose self assessment. You may want to check with NCS if you can bring copies of your husband passport or it needs to be original for them to copy, not sure about that.

Copies of British passport (all pages) are accepted.
There is no need provide proof of income for naturalisation his work is not relevant. If you are not working at the moment, your work is not relevant (even if still registered as self employed).
You will also need to submit a marriage certificate.

With regards to evidence of the rules then unlike standard naturalisation application , spouse of BC don't need to meet the future intentions requirement so where you plan to spend your life (or where your husband spends his time) is irrelevant.

So all I need to submit is copy of my passport (all pages) as I will travel during application process, copy of my husband passport (all pages), marriage certificate , Expired Ielts certificate and life in UK certificate.

I don't need to submit my P60 or to prove I was pregnant and receive maternity allowance.

One more question , are you sure there will be no problem if my passport will be stamped with the resident permit of the country where my husband will be working in?

I don't know the answer to that one. On one hand as soon you apply you are free to travel and on the other hand on AN form you have to state where you plan to live.

Not an issue. As I said, spouse of BC is not requited to meet the future intention requirement.
