Hi there,

My wife and I came into the country in 24 Jan 2011. I am a British National and below is the history of my wife immigration.

First Arrival + 24 Jan 2011 on UK Spouse Visa ( Married to UK National)
Left UK on- 16 Nov 2011
returned to UK - 1 Oct 2012
ILR Granted- Mar 2013

Since Mar 2013 we have been continuously living in UK. However, from the period 17 Nov to 30 Sept 2012, 10 months we were mot in UK. Considering this period out of UK , My query is when should we apply for citizen to complete the 3 year UK residency requirement for nationality and also should we consider that Home Office has a discretion of waiving 270 days spent outside UK during the 3 year period.

thanks.

You have already been advised that discretion will need to be ask for because of her absence. Asking the same question again will not result in a different answer.

Again, she should wait a few months and make sure that her absences in the 3 year period immediately before the date of application are no more than 270 and no more than 90 days in the last 12 months.

However, as she has must have been physically present in the UK exactly 3 years before (2011 and day/month) on the date HO receives the application.

Unless you ask for discretion, you risk losing the fee if she does not meet the requirements.
