Sorry, I'm getting confused here.
My son was born in the UK at the time we he parents had Tier 1 (General) Visa - we both have had ILR now for over a year.
Which section shall I apply to register him as British citizen? Section 3(1)?

Apply under Section 1(3) for children born in the UK. This is an application of entitlement.

Section 3(1) is for children born abroad and is an application at discretion.
