Not Married To Childs British Father , EU National , No ILR

Hello everyone,
came to this forum while googling for answers about my sons passport application .
I will try to provide as much info as i can to make you see what the problem is .
I am Lithuanian , came here in Dec 2003 . Got 2 kids , born March 2006 and June 2007 , their father is British,but we are/were not married .
My second son has got a British passport , but firs born cant get it because the law is different for children born here (in march 2006) to British fathers if were were not married .
I did not have permanent residence as not been here long enough before my first son was born .
So we are stuck , i really dont want him to have Lithuanian nationality because : he doesnt speak / understand Lithuanian (first and only language he speaks is English), has never been to Lithuania , and has no reason to visit ( both of my parents passed away , and i do not have any siblings) .
And i do not want my kids to have different nationalities - seems the problem is the dates , one law for children born in the first quarter of 2006 , and the other for those after 2006 May (?) .
My question is , will providing DNA test result be good enough reason for application to be approved (as in child having British father ) ?
And is this the only option ? Anyone been in similar situation ?
