RE: REFUSAL OF CHILDS BRITISH PASSPORT APPLICATION

I HAVE RECENTLY SUBMITTED A BRITISH PASSPORT APLICATION FOR MY DAUGHTER WHO IS 10 MONTHS OLD. I MY SELF AM A BRITISH CITIZEN AND HOLD A BRITSIH PASSPORT, HOWEVRE MY DUAHTER WAS BORN ABROAD IN PAKISTAN. MY APPLICATION WAS REFUSED ON THE BASES THAT MY NATIONALITY WAS INHERITED FROM MY FATHER AS I WAS NOT BORN IN THE UK . I CAME TO THE UK AT THE AGE OF 3 YEARS OLD AND HAVE RESIDED IN THE UK EVER SINCE I HAVE BEEN EDUCATED IN THE UK. THE ONLY TIME I HAVE LEFT THE COUNTRY IS FOR A HOLIDAY.

AS I UNDERSTAND THAT THE REFUSAL WAS ON THE GROUNDS THAT DUE TO THE FACT MY FATHER PASSED HIS NATIONALITY OVER TO ME I THERFORE CAN NOT PASS THIS DOWN TO MY CHILDREN.

PLEASE CAN YOU HELP ME WITH THIS SITUATION AND GIVE ME AN ALTERNATIVE SOLUTION.

Your child would only be British if born in the UK. Because you are British by Descent, you cannot pass it on to children born abroad. You will need to register the child as a British citizen under Section 3(5) of the BNA - this is for children born abroad to parents who are British by descent.

Once you have registered the child, only then can you apply for a passport.

Section 3(5) would require the other parent to have also been in the UK for 3 years. May have to be a section 3(2) application. The latter would give citizenship by descent.

Hi Guys

i undertant that i have to apply for my daughters British Citizenship under Section 3(2) but hoever is this still the procedure if my daughter is in Pakistan or does she have to present here in the UK for me to apply for Bristsh Citzenship.

From Pakistan is ok if you meet the requirements.
