Dependent visa or ILR

Dear Expert,

Hope some one will be able to answer my query.

If child born in uk whose father holds british nationality and mother indian passport.

I know child can apply for indian passport because of mother but can child apply for ILR straightway or he has to apply for dependent visa.

Just to clarify, parents doesn't want to apply for british citizenship for child because they will be moving to india in next few years.

Please ask if my question is not clear. Thanks in advance guys.

If the child is born in the UK and one of the parents was British at birth, the child is a British citizen at birth automatically.

As s/he is a British citizen, UKV&I can not issue a visa, either ILR or dependant visa, to the child as s/he already has right of abode in the UK.

What you can do is get an Indian passport and then get a Certificate of Entitlement/Right of Abode stamped into the Indian passport.

The form required is form ROA.
