Hi all, me and wife (my dependant) were granted ILR on tier-1 general route on 17th Sep, 2013. All together she spent four years two months (last one year on ILR) with me as my dependant in the UK. Can she apply apply for naturalisation the same time as me? Or she has to complete five years in the UK before she applies for naturalization? Would be grateful for your advice. Regards

Probably safer to wait until she completes her five years as well.

thanks Vinny, i remember reading few months ago that dependants can apply the same time as long as they have lived in the UK for three years and last 12 months on ILR. But I can not find anything now. I am slightly confused because she was granted ILR as my dependant same time as me, even though she lived in the UK for three year at the time of application.

She can only apply on the 3 years residency if you are already a British citizen as then she is applying as a spouse of BC, which she is not if applying at the same time as you.

So she either waits to complete 5 years residence or applies once you have attended your ceremony and you receive your certificate.

It would be safer to do so as long as she meets all the standard requirements for spouse of BC, 3 year residence.

The HO have removed the reduced 'joint application' fee, so there is no benefit in applying together anymore.

Many thanks CR001. My son was born in the UK, he was granted ILR the same time as us, should I apply for his naturalisation the same time as mine? (17th Sep). Or if I does not make any difference to the fee then I may apply for his naturalisation right away, as he is eligible from the day we were granted ILR.

It makes now different as his application under section 1(3) is an entitlement to register so you can register him now. If you do his in September, there won't be any difference in the fee payable.

I am planing to apply for my son's naturalisation before us, he was born in the UK. Just read the form, which requires two references including a professional reference. He is only three and has not started nursery yet, how would we get professional reference for him?
