Citizenship for my child born outside UK

Hi,

I have gained the British Citizenship through Registration recently. My wife and son, who was born in Hong Kong, are living with me in the UK at the moment. Their immigration status are dependents of ILTR person (my previous status), their visas are valid until 2016.

I understand that my wife cannot apply for the citizenship until she has stayed in the UK for 5 years.

Can I apply British Citizenship for my son now ? Which form should I use ?
If not, when I can do so ?

Thanks a lot !!

Regards
Leo

Your wife must be settled (have ILR) and have been resident for at least 3 not 5 years as you're British.

The child is different, it's discretionary, which is unlikely to succeed until they're both settled.

Thanks for reply Amber.

My son will turn 2years old soon. If he remains the ILTR dependent status, will it affect his rights to education and benefits? E.g. early education fund, free education. Or he will have the same rights and benefits to education the same as other British children?

Thanks
Leo

He won't be disadvantaged in terms of his rights.
