Criminal conviction - referees and waiting times

Hi
1. I'm an EEA national. In 2010 I got a fine - in my country it becomes spent after 5 years. On the other hand here in UK you can apply for BC after 3 years of conviction.
Does that mean that you can apply even though you have unspent conviction now in 2014?
2. The other question is about referees. Do I need to inform both referees that I have criminal conviction? Does the UKBA when they call referees, asks the referees about my conviction declared in application? If the referee answers that he didn;t know about my conviction will that matter to UKBA? It doesn't state in any guides I read.
