Eligibility Confusion - 90 days compensation Tier 1 route

Hi,

Tier 1 granted 28th May 2009
Landed in UK 7th August 2009 - within 90 days
ILR granted on 3rd May 2014 - I applied on Window 28 days earlier under 90 days compensation rule

When can I apply for British citizenship? On or after 3rd May 2015 or do I need to wait until 7th August 2015?

My wife landed in UK on 27th March 2010. She got ILR with me on 3rd May 2014. When is she eligible?

You must hold ILR for one year before you can apply.

So that means I can apply after 3rd May 2015. But my 5 years in UK will not be completed until August 2015 as I landed in UK on 7th August.

When is my wife eligible as she landed in March 2010 and got ILR with me on 3rd Mar 2014.

On or after 3rd May 2015 or do I need to wait until 7th August 2015? 3rd May 2015 onwards, providing you were physically present in the UK on the same date in 2010 that the HO receives your application and you are within the absence allowance, you have LIUK and English level B1.

My wife landed in UK on 27th March 2010. She got ILR with me on 3rd May 2014. When is she eligible? She can apply after 3rd May 2015 as she will have met the 5 years residence requirement, provided she was physically present in the UK on the same date in 2010 that the HO receives her application and she is within the permitted absence allowance, has LIUK and English level B1.
You landed in the UK 7th August 2009 so why do you say your 5 years will not complete? Your application will be based on 5 years immediately preceding your naturalisation application (which includes 1 year on ILR), i.e. 3rd May 2010 to 3rd May 2015.

Same goes for your wife. On 3rd May 2015 she can apply for naturalisation as she will have been resident for the last 5 years and had ILR for one year.

My bad. I was confused for no reason. I was counting the years until 2014. Thanks for the help guys.
