MN1 Child Born in India to Naturalised British Parents

Post by algin8 » Sat Jan 31, 2015 1:44 am

Dear Forumites!

Me and my wife are naturalised British Citizens.
A couple of weeks ago, we had our first child born in India as my wife preferred giving birth over there.
I am just back in the UK from my 2 weeks paternity leave.
I managed to get her Birth Certificate issued by Indian State Govt which mentions her permanent address as UK.

I am using MN1 form to apply for her BC and intending to use VFS in Hyderabad.

I need help on few issues as below:

- I am not sure which section of Immigration Act her application would be considered? I first thought section 3 (2) but it says parents must be BC by descent (we are BC by Naturalisation)
- As I am in the UK, i want my wife to be the applicant. Do I still need to send my notarised passport copy for this application?
- We cannot find any British Citizen as a 2nd referee. Can we use any doctors in India who we know?
- Is there any correct list of supporting documents (father's and mother's) required for this application?
- What are the usual processing times these days from India?
- Can my wife use my Uk debit card's details to pay for the application fees?

Would really appreciate any help.

Cheers

If child was born after a parent was naturalised, then child is automatically British.

A British child may apply for either a British passport or a CoE-RoA.

Thanks Vinny for replying.

gov.uk says it takes at least 16 weeks or more for an overseas British Passport applications and I don't think we want to wait that long

I guess I am tending to consider either CoE-RoA or Emergency Travel Document (ETD)

The text relating to CoE-RA says its a certificate that goes in your passport (My new born doesn't have any passport at all as yet) so does it mean she can only avail ETD besides waiting quite a bit for a British Passport?

Just wondering what is the difference between the above two and which is quicker and easy to obtain.
Does my new born daughter qualify for both of these?

Thanks again in advance.

Child may be ineligible for an Emergency travel document, especially if there is no emergency.
Get an emergency travel document wrote:You can apply for an emergency travel document (sometimes known as an ‘emergency passport’) if you’re a British national outside the UK and your passport has been lost, stolen, damaged or has expired.
