Hi,
I received my Indefinite Leave to Remain (ILR) in the UK last year. After giving birth to our son in the UK my wife left the UK 6 years ago and went to Bangladesh, as she needed support of family members in bringing up our son. Now, since I have obtained my ILR and my son is older (7 yrs), I wanted to bring them back here in the UK and stay with me. What would be the best possible way for me to apply for them?
In summary: My self: ILR, My son: Born in the UK, My wife: stayed in the UK for 5 years and then left for Bangladesh.
Any suggestion would be great.
With Regards,
M Khan

Settlement (spouse) visa - form VAF4A and Appendix FM, you have to meet the financial requirement and she needs to meet the English level A1 requirement. This is a 5 year route to ILR made up of 2 x 2.5 year visas, meeting the same requirements at each stage.

You could register your son as British on MN1 under section 1(3), which is an entitlement as he was born in UK. Once you receive the registration certificate, apply for his passport of a Certificate of Entitlement.

Dear CR001
Thanks so much for your straightforward reply.
Makes life easier.
Couple of things I also wanted to clarify:
(i) Financial requirement for spouse is earning of 18,600 GBP. For spouse & a kid is 22,400 GBP.
If my son gets registered & then naturalised then I only have to meet the financial requirement set for spouse only (18,600 GBP). Am I right on this?

(ii) Do I need my son's & my wife's Bangladeshi passport to register him (my son) as British citizen?

A response would be highly appreciated.

Dear CR001,
I had couple of questions. Wanted to thank you for your patience & support before asking it.
(i) As you have advised me, I went through the link.
I still one confusion.
Do I need my son's Bangladeshi passport, while applying for his registration as BC?
(on the Eligibility section it says only about birth certificate and evidence that the parent has ILR, but on the Application form, it says about Child's passport).
Since, I don't have his passport on me, I wanted to know if I could apply without it.
(ii) I can see that there is no residence requirement for application under section 1(3).
While filling up the MN1 form, on the section 2: Residence requirements, I am not sure about questions 2.1, 2.2, 2.3..
I know the answer for 2.4.
A response of these questions would be great.
Good night :)

Hi,I am a British citizen. I am planning to apply for my wife (who is in Bangladesh now) on a 'dependant of a settled person' visa.
My wife was in UK for about 6 years, then she left for Bangladesh in 2010. Our son was born here in UK
Our son (who is currently in Bangladesh with his mum) has got his British nationality recently, just awaiting for his British passport.
What should be the procedure?
Do I need to wait for him getting the British passport, before applying for my wife's visa?
Any response would be hugely appreciated.

Welcome back and congratulations on registering your child as British. I believe you are asking the same questions as you did in your first post, which were then answered in the first reply by CR001
