FPN By Court by Error.

Hi Sr Members,

I have to create this new post as i couldn't find a way to post in BC section from my earlier post.

in 2011 i asked advise for the below issue and thanks to members i got reply that not to worry about this FPN for ILR

Hi,

I was stopped by Police for not wearing seat belt in a taxi and was given a fixed penalty notice for 60 Pounds.

I have two options to pay 60 pounds by Cheque or take a online test on seat belt safety and pay 25 Pounds.

I took the online test , cleared it and paid 25 pounds. I have the proof on the same

Now i have got a Fixed penalty collection order for the same offense for 90 pounds stating that i have not paid this. The notice says its a court order

Paying again 90 pounds is no issue but i am extremely extremely worried if this will affect my ILR or Citizenship

can one of you advise what i need to do to make this clear of my records.

i plan to call them tomorrow to explain this but not sure what is the right approach. do i still pay the 90 pounds or explain them that i have already paid this.

now in 2015 the rules have changed for section 3.10.

Kindly i ask to sr members due to new rules do i need to declare this FPN in Naturalisation application in section 3.1. I plan to apply through the NCS .

Personally I would contact Police to be clear its not the exact same offence. If it is, I'd request it to be removed so you dont have multiple FPNs in your records.

Sorry, i realize i didn't complete my full quote.
I called up the court which issued me the fine and clarified. they accepted the error and cleared this.
i dont have any issues in that front.

this was in 2011

during ILR i didn't declare and i had no issues

now my question is due to the new rules ( simple caution) and after reading the application form section 3.10 do i need to declare this.

No I dont think you need to declare that at all, since it was an error on Court's side and they have struck it off their records, so I am thinking that if you declare it and HO could not find it that actually might have a negative impact.

Based upon that logic above, I'd personally not declare it, but you are welcome to sought other opinions.

I agree in the court error part.

my question is still - i was issued an FPN for not wearing seat belt in back seat of the taxi which i paid the fine.

do i need to declare this in the simple warning section of the application form.

this happened in 2011

kindly advise.
