Child Born in UK to Parents not having ILR as yet

Hi,

I am working in the UK on Tier 2 General Visa since 2012, living with my family they are on Tier 2 Dependent Visa. We will be applying for ILR in June 2017. Our current Visas expire on Nov 2016, and will need to apply for 1 more extension in Nov 2016 before ILR.

Our child was born in UK a couple of months ago. We have no plans of travelling out of the UK for next 2 years (till the time we apply for ILR).

There are a few queries which I have related to the above:

1) Do I need to register my child as a Indian Citizen?
2) Do I need to apply a Indian passport for my child even if we are not planning to travel?
3) Do I need to apply for his visa when our visa comes up for renewal in Nov 2016?
4) Does the new rule of IHS apply (Immigration health surcharge came into effect from 6th April 2015) to us when we renew our visa in Nov 2015? If Yes, then do we need to pay for our child who was born in UK?
5) Do I need to add his name in our ILR application?

1) Do I need to register my child as a Indian Citizen? Your choice but child will assume your current nationality anyway. Is the ultimate aim to obtain British Citizenship for the whole family??
2) Do I need to apply a Indian passport for my child even if we are not planning to travel? No, but what if there is an emergency and travel is needed?
3) Do I need to apply for his visa when our visa comes up for renewal in Nov 2016? No, not if there is no travel plans and you plan to apply to register child as British Citizen.
4) Does the new rule of IHS apply (Immigration health surcharge came into effect from 6th April 2015) to us when we renew our visa in Nov 2015? If Yes, then do we need to pay for our child who was born in UK? Yes, £200 per year per person payable upfront for the duration of the validity of the extension. It will only be payable for the UK born child if you apply for a Tier 2 dep visa.
5) Do I need to add his name in our ILR application? No, not if you plan to register him as British Citizen once you have received ILR. If you only want your family to hold ILR, then the child will need a Tier 2 dependent visa first and an Indian Passport.
