So my boyfriend who's Australian qualifies for a Certificate of Entitlement to Right of Abode in UK, was wondering if anyone could help a couple things we need to check.

1) what documents should be sent apart from his birth certificate, passport, his parents' birth & marriage certificates? Is it a case of the more the better?
It doesn't say any bank statements/evidence of money to support himself is needed, but is that good to send?
Any examples of what people who got accepted have sent before?

2) Where should the app even be sent if applying from outside the UK? It doesn't...actually say on the gov site. It says apply online in Australia, but you also have to print off the app and send it along with the supporting documents. No idea where to.

3) One last thing kind of an extra I wanna double check, it says in the guidelines on documents need to be sent:
"Evidence of your permission to be in the country where you are applying, if you are not a national of that country. This could be a residence permit, ‘green card’ or valid visa showing your current immigration status."
-- this only means if he's not a native where he's applying FROM (Australia), right?

Basically just any guidance or experiences of this stuff would be awesome because we wanna get this right.

What is the basis for his claim?

He has a UK born parent and he was born 1991. Hence I already mentioned the parents' birth and marriage certificates and his birth certificate. I know we need those.

Why doesn't he just apply for a British passport if he has British parents?

He has one parent born in the UK but that parent doesn't have a British citizenship/passport anymore I don't think, I figured this route was quicker and easier than him applying for a passport? I read somewhere on here it was quicker and easier.

You don't need the passport of your British parent to apply for a passport. You need the birth and marriage certificates for the parent and the applicant. Both processes could take the same amount of time sometimes but passports are processed in the UK and I think ROA is processed at the British High Commission.

He's applying from outside the UK, would that make any difference to the time it takes for either process?
Also, don't you have to take a British citizenship test and stuff, whereas with RoA he would just send off the stuff and it said he doesn't even need to visit a Visa centre.

No, it is a passport application for someone who appears to be British by Descent. It is the naturlisation applications which the tests are for.

Which parent is British, mother or father?

Passport applications are also posted but he will be required to attend an interview which is standard for all first time adult passport applications.

ROA might be the easiest then and if/when he does come to the UK, he can apply for his passport here.

The other thing to weigh up is RoA only lasts as long as the foreign passport;
it will require renewing/reapplying whenever that passport runs out & has to be renewed.

His father is the British-born parent. And yeah, I mean we were thinking if he wanted it to be more long-term he would go through that process once here. So he'd get the RoA as a kind of in-between so he could get here, then apply for a British passport when he's here, that way it wouldn't matter that the RoA runs out when his passport does. But we will weigh up that aspect.

If he were to apply for the RoA, do you have any advice on the stuff in my original post? Like, what other documents should he provide, is evidence of finances good to send, and where does he even send the application?

Not needed, he is not applying for a visa! He only needs to submit what the application asks for. ROA is more expensive than a passport.

And yeah I read that page but all it says is that he needs to apply online if he's outside the UK, doesn't say where to send his documents? Or did I misread it

Thanks again for everyone's help, one last tiny question:

With a British passport, will this mean immigration won't ask any questions, he'll just be treated like a British citizen? That seems like such a dumb, obvious question, but I want to get everything 100% right and I get confused with the terms ie. whether it's the same thing as a citizenship, what rights it brings, etc. but mainly just, how it will work at the airport.

As his father was born in the UK, he is a British citizen by descent. Therefore he gets a British passport.

He will be treated just like any other British citizen at the counter. His passport will be used to identify him, but that is it. They will verify that his face matches the photo and let him through, no questions asked.

As a citizen, he has the right of abode (the right to live) in the UK and the Immigration Officers can not question that.

If he does not wish to face them, he could use the e-passport gates, which will scan his face, match it to the passport biometrics and let him through.

As an aside, his children will not be British, unless born in the UK.

im wondering if some one can tell me what the turn around time for right of abode? i know this is not where i should post this, but i am having trouble working out where i should post. I am an Australian with an expired passport and right of abode. I applied for the right of abode in may.The money has been taken from my account. Any ones experience would be great.
