Please need help from experts in the forum. I am in Tier 1 General now and applying for ILR on November 16th 2015 using same day service. I am thinking to apply citizenship through MN1 registration process for my daughter (she was born in June 2015).

we need to travel to India in mid-jan 2016 for my brothers marriage, can my daughter travel to India after starting the MN1 registration process and return back to UK without any issue through immigration and airports. I still didn't apply for India passport for my daughter but realised that i need apply for that as we have to travel to india will need a travel document for her to enter india.

My query is can she return back to UK without any problem, i don't want to apply expensive ILR for my daughter just for a month travel. is there any other way i can escape the cost of ILR? can i apply visit visa for her india and use that to enter UK and resume the registration process once back in UK.

another query while making MN1 registration process for my daughter what are the documents i need to submit? do i need to submit my original BRP or passport? if yes when would i get them back? can i use NCS for my child's MN1 registration process so that i can keep my originals with me

Yes you can apply for her on MN1 and if you use NCS then you get to keep your original documents because they make copies. Please read the MN1 form and guide for documents etc. and see 'Children' section in the FAQs link below

She will not be able to re-enter the UK or board a plane if she does not have a visa for the UK. I am not sure she can apply for ILR if she does not currently have a visa or a passport.

I am applying Indian Passport for her this week, so my daughter will have the passport by that time.

is there any other less costly visa i can apply for my daughter instead of ILR?

Instead of applying ILR i am thinking to apply for MN1 registration, travel to India and apply visit visa for my daughter to return to UK and resume the registration process does this make any sense?

Your daughter will likely be ineligible for a visit visa. The clue is in the name (visit visa).

For a visit visa, you need to show that she has strong links to India and that she will leave the UK and return to India within six months. How will you be able to prove that when she has a pending MN1 application in the UK? And where will you apply for a visit visa? You can't apply for a visit visa in the UK!! And from India, it could take weeks to get a certain rejection.

And if the MN1 application is approved while she is in India, it could take six months to a year to get a British passport (her Indian passport may be subject to penalties and there may be issues with Indian authorities as she will have stopped being an Indian citizen on becoming a British citizen). She will be unable to return till then. As a British citizen, she will no longer be eligible for visit visa.

The way I see it, you have no choice but to get ILR for her and then apply on MN1 after you and she return from India.

I think you have the answer and that's the only way.

Can you get your brother to postpone his wedding? That would give you the time to iron these matters out.
