Hello,
My daughter was born in UK and got ILR. But she is out of UK since last 2.5 years. hence, ILR expired and returning resident visa application rejected based on the same.
Can I register her as British citizen using MN1(section 1(3)) form from inside UK? If so how to get the biometric as she is not in UK?
Can I apply visitor visa in the mean time to bring her to UK? Does it consider as illegal stay?
Your help is much appreciated.
Thanks.

Whether the child can be registered or needs to be registered firstly depends on parents' nationality & immigration status.

How about status of other parent?
&
when was your ILR obtained (compared to child's DOB: ie before or after obtaining ILR)?

Once at least one parent has settled status (eg ILR), a child born in UK is
entitled to be registered as a UK citizen under section1(3) of BNA;
(use form MN1).
Application on this basis can be made from UK or from abroad, bearing in mind the need to submit biometrics,
After registration, a first British passport can be applied for; (separate process).

Can we apply the British passport within UK though she is in India?
What's the best visa to bring her to UK until complete the citizenship process. The return resident visa was rejected.
Thanks..
