Dear Members,

I am an EEA national married to another EEA national.
My spouse exercised Treaty Rights and I didn't so I want to apply as a family member of an EEA national.

How should I fill section 2.4.
Should I tick "Are you an EEA national?". or "or a family member of an EEA national"?
Should I fill the table and sections 2.5 and 2.6 providing that in section 2.4 it says "if you are not an EEA national, go to section 3?"
If so, should I put my spouse details there despite it relates directly to an applicant - "Please state on what basis you were in the United Kingdom for the last six years."

Many thanks

Q2.4
Interesting question - you could tick both & explain it in 'additional info' section of the form.
Or just tick "family member".

Probably advisable to add a covering letter or explanatory paragraphs in 'additional info' section of form to explain your circumstances clearly.

You are an EEA national so don't leave 2.4 onwards blank nor skip it.

Q2.4 - table suggest fill in as 'dependent family member of EEA national';
(as a dependent your economic activity in UK is immaterial)

Q2.5 doesn't apply as a dependent you weren't exercising treaty rights.

Q2.6 doesn't apply as a dependent you weren't exercising treaty rights (even if from A8 country)
