Residence qualifying period.

Hi All,

I have a question in regards to my qualifying residence permit to apply for Naturalisation.

I plan to apply for my Naturalisation on 11/11/2015.

I was not in the country on 12/11/2010, in fact I was away from 30/09/2010 to 01/04/2011.

Although I was legal, due to some circumstances I was away from the country for nearly 182 days, but since I am applying on 11/11/2015, I am not worried about the long stay as this will be divided in two consecutive years as It did when I applied for my ILR on 27/10/2014.

Does this breach my residence requirement?

If you were not physically present in the UK on the exact corresponding date 5 years ago that HO receives your application, it is an automatic refusal and loss of fee. You will need to wait until April 2016 before applying to meet the 'physically present' requirement.

Do you have a British spouse?

I would suggest you wait till April next year and apply the same date as that you arrived back in the UK in 2011.
