Citizenship for Partner & Chlid

FIrstly Many thanks to the Admins for the awesome site.. and brilliant insight.. :) This has helped me get my ILR.. :)

The confusion -
I am on ILR and would be applying for Citizenship soon. For all practical purposes would be a British Citzen in 12 months time. Were settled here and I am looking to get my wife and child too on citisenship.

My wife thought doesnt have ILR. She has been with me here in the UK for quite a while and her first dependant Visa was almost 8 yrs ago.

I understand that she would be eligible for citizenship soon after I get Citizenship - but I've heard conflicting views..!

I did read somewhere that partners partners needs to wait for 5 more yrs, then ILR then citizenship etc.. which makes it 10+ yrs for wife of partner to have citizenship.. seems insane..

Whouldnt my wife and 3 yr old son be eligible rightaway. (UKBA seems to indicate so)

Can someone validate this or provide views pls. Especially anyone who has applied.

Where was your child born?

What is your wife's full immigration history and what on what basis did you obtain ILR (5 years or 10 years)?

Your wife cannot apply for citizenship if she does not have ILR.

No, it does not say this anywhere. 5 years on a qualifying visa and then ILR. When she can apply depends on your answers to my questions above.

Citizenship is usually applied for after holding ILR for 1 year, unless you are married to a British Citizen as then you can apply immediately after being granted ILR.

Hi Thanks..

I got ILR on 10 Yrs Long Residence

Wife's immigration history

Tier-1 (General) dependant granted on May 2011
Extension on May 2013.
Current status - Tier-1(General) dependant -- yet to switch to ILR dependant


Child - born outside EEA.

Tier-1 (General) dependant on May 2013

And this one? What is her FULL immigration history?

Your child will be issued leave to remain in line with the mother. Child will be expected to have ILR to qualify for citizenship.

They both would have likely qualified for ILR with you if you had applied on the basis of Tier 1 G.

May 13 - till date - Tier-1 General Dependant
Sep 2009 - Tier-1 - Post Study dependant
JUly 2008 - Student Visa Dependant
June 2006 - Work Permit Dependant

1. Your wife needs ILR before she can qualify for citizenship.
2. Born-abroad child is expected to have ILR. Child will be eligible for ILR only when mother is.

If you are a British citizen on the day your wife is granted ILR she may apply for citizenship immediately provided she meets the mandatory requirements.
Child may apply for registration as British citizen after your wife has ILR but ideally should apply when wife applies for citizenship.
