Passport or Registration for my son?

I had my son in September 2013 and got PR in November 2013,however my 5yrs RC expired in Jan 2013 mean I have exercised treaty rights for 5years before given birth.
Question is,can I apply straight for British passport for him and what do I need to submit?

If you mean you received
confirmation of PR (PR card) in November on the basis you had acquired PR automatically in January then you can apply for child's passport directly.
However be sure as the mere expiration of a RC means nothing more than it expired.
If you are a non-EEA national, was your sponsor
exercising treaty rights continuously for
5 years up to January 2013?

Otherwise, if your settled status (PR) was actually acquired later, as of November, then it's a case of registering child first, under Section 1(3) of BNA; (
assuming he was born in UK)

Thank you for super fast reply.
Yes,I received confirmation of PR in November 2013 as I qualified in Jan 2013.
How should I proceed with the application,what documents do I need?
My non-eea family member got his passport last week.

It's all in the link posted above.
Note If you apply with PR card the HMPO may think you had PR too late (after birth of son).
If that happens they may reject your application & tell you to go for registration first.
(There have been 1 or 2 cases like that reported in the forum).

You will have to really spell out the dates & your timeline exactly as the HMPO caseworker may not be expert in EU treaty rights & PR & PR cards.

Will use all the documents I used to obtain my PR from Jan 31st 2008 to Jan 31st 2013.
