Good Character?

Hi, I need help! I was granted IRL in 1999 but I 2008 was sentenced 40 days of imprisonment. I have recently done a criminal check which was purpose for a job and it came out with NO CONVICTIONS FOR DISCLOSURE. therefore, I want to know if this can stills affect me for my good character as I am about to apply it.

You'll be refused, you've got to wait at least 10 years since the end of your sentence. I assume the 40 days or part thereof was served rather than suspended?
