Dear Vinny, Amber and respected Gurus,
My 2 year old child and l are currently Tier 2 general dependants of my husband. Our leaves including my husband's leaves to remain are valid till 15 April 2016. My husband is eligible for settlement in July 2016. My husband and l will be extending our leaves before leave validity date but ]we are not intending to extend my child's.
Question - Will there be any issue registering my child as british citizen after my husband obtains settlement in July 2016 since my child would be without leave to remain from 15 April 2016 prior to application to register as British. My Child will not be travelling out of Uk before my husband's settlement application.

Thank you for your help

No issue. HO might write or question why he is not being included in your applications but you can advise that he will be registered as he is UK born.

As the child has had leave to remain, will it not be illegally present once the leave expires?

Will medical insurance be in place for the child while it is illegally present? I'm not at all sure that NHS costs will be covered. The child will cease to be ordinarily resident under the charging regulations. (I'm assuming the family is in England - Scottish and Northern Irish laws are different, and may not have been maintained to constrain the home Secretary's malice.)

(Error deleted - this registration is by right, not at discretion as I mistakenly thought.)

Secondly, might allowing/causing a child to be illegally present count as evidence of the parents' bad character if they choose to naturalise?
