Hello,

I want to apply for naturalisation but not sure if to go ahead or not. I came to the UK with a Spouse visa in 2010, got my ILR in December 2012 and applied for naturalisation in January 2013 based on my marriage to British wife. It was refused and the home office advised I apply in December 2013 when I am 3 years in the country.

In November 2013, I had CCJ from one of my credit card which I set up arrangements to be paying back monthly.

In October 2014, got a fine (the fine was from the previous year when I was looking for work, going through material problems that led to the end of my marriage and moved house) from court for train ticket I completely forgot to pay. I paid immediately I got the letter.

With all of the above, can you please advice me if I can apply for naturalisation or will I be refused on good character?

They shouldn't be reasons for a refusal, but they must be declared.

Thanks for your reply Casa. Does it mean that the fine I got from the court in October 2014 won't be taken as non custodial sentence and I won't have to wait for the three years rules regarding that?

It will be taken as a non custodial sentence (you weren't detained in prison).

As I saw in one of the post, it says "A non-custodial sentenance is only generally a bar for 3 years" does that mean I have to wait for 3 years from when the magistrate court issued the fine in October 2014 or am I okay to apply now? Sorry for the many questions I just need to be sure so I don't end up wasting money and get refused like in 2013.

You appear to have miss-read 'custodial' for non-custodial.

Thanks for your reply. I take it I am okay to apply without rejection as long as I declare the CCJ and court fine from TFL.
