MN1 Form Guidance - Born Abroad

Hi,

I would appreciate help from experts on below:

1.1 Please indicate the section of the British Nationality Act 1981 under which you would like the application considered.

Below details might be helpful

a) Father: Born and originally from Afghanistan.
b) Father Acquired British Citizenship by Naturalisation in October 2007.
c) Married to the Child’s mother in February 2008
d) The child was born abroad in November 2008; birth certificate does mention the father name.
e) Mother and child currently holding Pakistani Passport and never been to UK.

1.2 Immigration and Nationality Directorate or Border and Immigration Agency or UK Border Agency reference number.

I have “Certificate of Naturalisation” and it does indicate Reference number starting with M and seven numbers. Should I write this reference number?

Sections: 2.1 - 2.3

I have left it blank because the child has never been to UK and is currently living in UAE (which is not a British Overseas territory)

2.4 In which country will the child live if this application is granted?

Will this make any difference on the outcome of the application?

Section 3 - Parents’ residence in the UK or the British overseas territories, where applicable

Should I fill this section (I think it depends on Section 1.1)

Section 4 - Good Character Requirement

I did not fill Section because the child is only 8 years Old. Is this OK?

Section 5 - Referees and Identity

I have entered the First references as the Child’s teacher, she is from India. The second reference is the Child’s neighbour and the father of the Child classmate. He knows the child personally. He is from Pakistan. Is this OK?

Child is automatically British. MN1 would be refused and a waste of time.

A child born abroad abroad to a parent who is British otherwise than by descent (naturalised) will automatically be British by descent.

No need to register.
Apply directly for passport.

Your name not being on the birth certificate might be an issue though and HO could request DNA evidence that you are the father.

Father name is mentioned on the Child Birth Certificate
Furthermore, Child's father name is mentioned on his current Pakistani Passport.

Father: Born in and originally from Afghanistan.
Father immigrated to UK as a refugee and Acquired British Citizenship by Naturalization in October 2007.
Married to the Child’s mother in February 2008
The child was born abroad in November 2008
Mother and child currently holding Pakistani Passport and never been to UK.

Apologies, I misread your original post.

Child is automatically British, apply for a passport directly.
