Was the child born BEFORE he became British?
If yes, then he cannot pass it onto his child.
Where is the child now?

And where is the child's mother or what is the child's mother's UK immigration status?

If child born after he became British then child is British by descent.
Is he married to the mother of the child as well as being married to you?
Is he named on the child's birth certificate?
When did he get his citizenship/attend ceremony and when was child born?
Might be difficult to bring the child to the UK without the mother. HO/UKVI are very much on top of preventing 'parent abductions or removal' without the other parents knowledge or consent.

Ok so good that can be passed on by descent
Yes married to her and me I'm the first wife
Yes he is on the BC
Regarding child coming here this would be with full consent from the mother of course

Bit unfair and cruel to separate such a small child form their mother.
Is your husband named on the childs birth certificate.

I appreciate your personal view about being unfair or cruel but there are obviously reasons why this needs to be done I for one would NOT opt for this unless necessary
Yes as previously posted he is on BC

UKVI may be looking for reasons birth mother is not accompanying child.
It seems this is not a single-parent family, mother does not appear to be estranged, and child has not been adopted so there could be complications regarding transfer of such a child to UK.

Ok so if this is not possible for permanent residency where do we stand on regular visits ?
Is there any need for visas I would think not with a BC passport ?

Well I suppose
if child has a British passport then she has a right to come to UK in the end. A citizen won't need a visa (and wouldn't be granted one).

So really what we are saying is as long as the child has a bc passport and is accompanied by father she can be allowed to stay here with no questions asked as she has a right to live with her father

One more question if you don't mind (last one). Is the child's mother also married to someone else?

I am not saying that. There are child protection aspects to such a case.
I'm sure there will be questions at various stages, including at port of entry.
But a British citizen does not need a visa.

Application for a child's passport
Who can apply
You can usually apply for a passport for your child if:
they’re under 16
you legally have ‘parental responsibility’ for them
You automatically have parental responsibility if you:
are the child’s mother
are the child’s father and are married to the child’s mother
were married to the child’s mother when the child was born (or, in Scotland, when the mother became pregnant)
have adopted the child (alone, or jointly)
You'll see that the only requirement your husband is able to meet is that the child in under 16. He hasn't been granted legal responsibility (by the Court)
The marriage to his second wife will be considered as bigamous under British law and not recognised.
He hasn't legally adopted the child

I don't understand he is legally allowed to marry more than 1 wife he is Muslim his child is entitled to BC passport why would he have to adopt his own child ? All we are now talking about is at port of entry what is required other than passport if the child is to come on visits regularly what other documents

He isn't permitted to take more than one wife under British law. This applies to all and Muslims have no concession.

If hubby is domiciled in UK he is subject to UK law which does not entertain polygamy for those resident in UK.
