Hi my brother is applying for this British Citizenship, there are 35 days overlapping i.e. Tier 1 ent visa issued on 15 May 2013 (issue date as per his previous BRP) and left his Tesco Job 25 June 2013. My brother said he was on sick in Tesco and getting sick pay from them. he sent his resignation on the same day his Tier 1 ent visa arrived but Tesco put the forwarding date when they processed his resignation.

My brother also saying that HO back dated his visa by few days as well.

I need your help. Does this cause any problem?

If he had a Tier 1 Entrepreneur visa, he should NOT have been working at Tesco and would have been in breach of his visa conditions.

It is more of an admin issue. My brother resigned on the same day when the approval letter came. Tesco put the wrong date when they process his resignation request.

Could you please explain what he can do to cover this 35 days. It is just an admin error.

I think he has 2 options.
1) ask Tesco HR to write letter explaining circumstances around his resignation and the date they received his letter .

2) if they are not happy to do that, make SAR request to tesco and get all his files including letter received from your brother .

then, you need to fully explain this circumstances on AN application and wait to see what HO will decide .

What was his visa before the Tier 1 Ent?

He was on Tier 1 PSW.
