Register New Born as British Citizen

Hi guys,

Another question for the gurus :)

I did read that a child born in the UK, if one of the parents is settled here or is a British citizen, is automatically a British citizen.

My question is: how and where exactly can somebody register his child as a British citizen? Is it done when the first passport application is made for the new born? At the register office when you register the birth? Or is it something else?

The process to follow depends when the child was born, before parent got ILR or after ILR.

Registering a child a British (if born before parent got ILR) is NOT the same as registering a childs birth.

You will need to provide a bit more information for anyone to offer the correct advice otherwise we are just guessing and wasting time posting information that is not relevant.

Hi Cr001,

Sorry you are right.

If one of the parents is settled in the UK before the child is born e.g. by having a certificate of permanent residence as an EEA national, how can the child be registered as a British citizen?

Hi there,

Thanks for directing me to the FAQs.

I did read the relevant section, but it doesn't exactly say what sort of application it is. It says that the only documents required are the birth certificate and evidence that parent obtained ILR/PR.

So, sorry to ask again, but what sort of application is that?

You seem to have missed the point.
If parent was settled first simply apply directly for passport.

Hi again,

Hmmmm that's interesting. So basically by applying for a passport the new born becomes a British citizen. I had the impression that when the child is born, it would be registered as a British citizen, if one of the parents holds an ILR/PR at that point.

A child born to a parent that holds ILR/PR (settled status) is automatically British and applies directly for a passport.

Registration as British Citizen is ONLY required if born BEFORE a parent has PR/ILR (settled status).

By being born, the new born becomes a British citizen.

No. However, for some nationalities, it makes a difference. For example, if someone entitled to Irish nationality applies for an Irish passport, they become Irish, simply because only Irish citizens are allowed to apply for an Irish passport.

Moreover, the grant of a passport does not make one British. If the Passport Office mistakenly grants a passport, the recipient does not become British. However, when the problem comes to light, say 20 years later, the passport application may then be treated as an application for registration or naturalisation.

You can apply directly for a British Passport if you acquired DCPR or ILR STATUS before the baby's date of birth.
Not sure if it's still useful but I can share my case of registering my baby as British Citizen successfully.

Baby Born: Mid 2015
Both Parents: Italians with 5 and 1/2 year of EC Treaty Rights.

We did not have DCPR (ILR for European) at the time of the application so along with the passport application we sent the same documents you would send for DCPR application (Proof of 5 years exercising EC Treaty rights)

Timeline:
Passport application sent: around 25th of august 2015.
Parents passport letter request: 4th of September 2015 (HMPO wanted to make sure we were Italian)
Parents passports sent: 1st of October 2015 (we were travelling in September)
Passport and documents received: 20th of October 2015

FEW NOTES
I went for a 7 days Fast Track Passport application but they did not accept it because I did not have DCPR or ILR. You may try to investigate on this and use Fast Track Passport application if you have DCPR or ILR.

My baby's passport application is prior the 12th of November changes that requires EU people DCPR before they can apply for their own Naturalisation. Not sure if relevant in this case.

Thanks guys for helping me with that. I do have a PR (EEA national) before the child is born, so I think this should be straight forward :)
