I've ILR for more than a year and have not more than 450 days absence over 5 year QP or not more than 90 days absence in last 12 months. My family was with me in UK until April 2016. My wife moved back to her own country - we are separated, not legally divorced yet. Her and my son's visa was expired in May 2016. I have all the intentions to live here, I've a full time job, rent a house and pay my taxes. Do you think Home office will have any reason to think to reject my application for Naturalisation on the basis of Appendix F (link below) Future intention to Live in UK. Please advise.

YOU are applying for citizenship and YOU have to meet the requirements.

If you are separated, state it in the form.

In the form the options on the relationship are,
1. Single/Never married
2. Married or civil partner
3. Unmarried partner
4. Divorced / civil partnership dissolved
5. Legally separated
6. Widowed or surviving civil partner

We are not legally divorced yet, she just moved out of the country. And there is no section to explain my situation in detail in the form. Please advise.

You are still married, so select married and provide more info in the 'additional information' section if you wish to.

Thanks for reply. I've another question. In my 5 year QP, I've an absence of 192 days from UK. I've been in out of the country due to project work. Do you think this will be an issue as the absence is more than 6 months?

'6 months' does not figure in AN requirements;
90 days in past year and 450 days over 5 years are the crucial limits.

"The fact that a spouse/ civil partner is living, or will shortly be living, abroad should not normally be taken as evidence that the requirement is not met if:
• the couple are separated; or
• the spouse/ civil partner/partner has applied for, and is awaiting, an entry
clearance; or
• we are otherwise satisfied that the spouse/ civil partner/partner intends to join
the applicant here; or
• it is apparent that the couple are content to live apart for the foreseeable
future "

I think I lean towards the last point - what shall I mention in the 'Additional Information' to justify that we are living separately for the foreseeable future? Kindly advise.

at last, didnt write anything about my relation. left it in the hands of HO people to decide. will explain if at all they call me for an interview.

Happy to inform that my citizenship application is approved. HO didnt question anything about my spouse. Glad all went fine! all the best for everyone!
