Hi this is my friend query.

He is British national and wife is also holding British nationality.
They have a son who is 6 years old.He was born in UK .Parents got ILR after his birth but could not register him as British becasue he was already in India.
Questions:-

Can they register him in India ?
He is eligible to apply for British Passport ?
He has to apply for settlement visa and then come to UK? will 18600 GBP will apply on parents?


Please advice

2) Not yet. Register as citizen first.
3) If registered and passport obtained why bother?

Register what? The child cannot apply for a British passport as he is not a British citizen.

You need to register him as a British citizen using form MN1 as advised. You can do this from India but you have to post all documents to the UK.

Once you have the certificate of registration, you can use it to apply for his British passport. He will automatically lose Indian citizenship when you do this.

Child is in India so is there any process to Register a child outside UK
My understanding is that if you are abroad then you can only apply for passport if eligible.

I can understand he is not British by birth there should be Registration process but how they can Register in India?

They cant do in UK as child will required Biometrics

You seem to file questions for many 'friends'. It may be easier if some of them register themselves and ask their own questions themselves.

If concerned person actually reads MN1 guidance it will be clear they may file registration application from abroad:

The process is the same outside the UK. Apply using form MN1: https://www.gov.uk/government/publicati ... n-form-mn1

You will need to send the application and all supporting documents to the UK. The child will have to enrol biometric information. This can be done in India

What is your issue?!

As suggested previously...ask your friend to register on the forum and we can advise directly. This thread is just going around in circles.
