Help: Applying for BC for my Daughter

Hi all,

Hope you can help me.

A little background:
I'm just starting the process of applying for my daughter (aged 7 now) to become a British Citizen. She was born in the USA but has been in the UK since she was around 6 months old. I am a British Citizen born in England, and aside from a 2 year period from 2007 to 2009, I have lived my entire life in the UK. Her mother is a US citizen but has lived in the UK since 2009 and has ILR. However, her mother and I are now divorced. Cut a long story short, I have just been through a nasty court case to keep my daughter and her brother (aged 6, a BC from birth in 2010) in the UK. So things are not good between us. There is however a court order stipulating that she must co-operate with me in getting our daughter a British passport and all that entails (including getting citizenship). I am also on an extreme budget, so I can't engage with a professional immigration agency to help.

Whilst I expect wrangling her mother is going to be difficult, I have a few difficulties I need some advice on:
  • 1. Should I use Section 3(5) on form MN1

    2. I don't know the exact date we re-entered the UK. Unfortunately my passport from that time was destroyed. Is it essential for this to be exact in the MN1 form?

    3. I don't know when exactly her mother (and therefore my daughter? - need clarification) got ILR. Is it essential for this to be exact in the MN1 form?

    4. I have no idea how to prove my daughter has been in the UK for the last 2/3 years because her mother gets all correspondence in regards to her. Would something like a Court Order be enough? or could her school be of assistance somehow?

If you are a British citizen by birth in the UK, your children are British citizens by descent wherever in the world they are born. Apply for a passport directly.

I concur that your daughter was automatically British when she was born.
