Hi,

Chid 1: 12 years old, born abroad, lived in UK since 2.5 years old. Has ILR.
Child 2: 8 years old, born in UK, has ILR, born before parents got ILR
Child 3: 3 years old, born abroad, has ILR, born after parents got ILR
Child 4: not yet born but will be born in UK, parents have ILR

So for child 4 I can apply for BC directly, correct?
For Child 2, who was born in the UK and we got ILR after, then I need to apply via MN1?

What about the other two kids? Child 3 we already had ILR but he was born abroad. Child 1 was born abroad before we relocated to the UK.

Child 1. May register, subject to discretion, at the same time or after parent's naturalisation.
Child 2. Entitled to register, after a parent is granted ILR.
Child 3. Same as child 1.
Child 4. Automatically British.

Child 1. Yes.
Child 2. No. Child is not yet British and, therefore, may not apply for a British passport until granted registration.
Child 4. No. Child may apply for British passport directly.

When you are applying for British citizenship as parents you use form AN, right? So when you need to apply for kids not born in the UK for british citizenship, do you include them with you on form AN or are they separate?

Does each member of the family require their own application, or is it one for everyone?

Form AN for adults and form MN1 for children under 18 years of age.

Does each member of the family require their own application, or is it one for everyone? Each person applying must complete their own form and pay a fee. Each person applying must meet all the requirements individually on their own.

Hi,

I'm sorry I still don't understand how to apply for my kids who were not born in the UK. I did my daughters application MN1 under section 1(3) because she was born in the UK and we both have ILR. But then my eldest child was born before we moved to the UK and I don't know what section he would be under because neither of us has citizenship. His ILR expires in May 2017 so I really want to get his application in. And then I have my youngest who was born abroad but we already had ILR. Don't know what section he would be under either?

There aren't any. If born abroad, they must hold ILR. If over the age of 13, they require 2 years residence. If this question relates to your 12 year old child, you can apply now with your application. The application will be a Section 3(1) application.

So eldest will be under section 3(1), also youngest? We all currently have ILR, have had it since 2012. Eldest's ILR is expiring in May of this year.

By definition, ILR does not expire. It is indefinite.

All children born outside the UK will have to apply under Section 3(1), with at least one parent applying for naturalisation or already having British citizenship. CR001 has pointed out the other requirements. Children over 10 years of age also need to meet the good character requirements.

Although the ILE entry clearance or B R P may expire, the Indefinite Leave status doesn't, unless the holder has been absent from the UK for over two years..

All of our cards have a valid until dates. Two of the kids ones expire in May 2017. The adults are until 2022. But they also say:

Type of permit
settlement

Remarks
Indefinite Leave to Remain

Does owning a home in the UK help towards the two year rule for ILR? And if you own a home but return for short visits is that acceptable under the ILR rules?

-Child's passport
-parent's marriage certificate
