Can some one advise me what would be the possible ways for my son.

i applied MN1 along with British passport for my son , and currently it is in progress...
My wife and son went to India because of family concerns , and they may not come back till May.

My worry is, My son Current Visa Expires on 20th April.. So he may come back only after his visa expired.


Please let me know what could i do on below situations?

1) If MN1 approved and receive British passport.. Can my son Surrender Indian passport and apply OCI in India?
, Can he travel back to UK with British passport?

2) If worst case MN1 not successful , on what visa can he enter into UK..(Apply ILE/R ?
because i am British and my wife is on ILR)

He can certainly enter the UK on a British passport.

However, once he is issued with a registration certificate, he becomes a British citizen. And British citizens can not be issued with a visa to enter the UK (because British citizens have Right of Abode in the UK). It can take between six months and a year for him to be issued with a British passport overseas. So factor it into your calculations that if your son gets MN1 while he is in in India, he can not return to the UK for about six months to a year after getting the MN1.

Sorry for the confusion,

Actually we applied MN1 when he was in UK...

Due to Urgency My wife and Son went to India , His current(Tier 1 Dependent) Visa expiring on 17th of April,
I expect MN1 gets approved before this date.


Please let me know what will be the situation if he want to come back UK in May or after(Once MN1 approved and Passport received i am planning to take to India), Can he travel on British passport?

He can get a Certificate of a RIght of abode stamped on his passport.

He cannot enter the UK with leave if he is a British, as UK citizens are not subject to the 1971 Act.
