Citizenship for Child

Hi All,

I am on ILR and eligible to apply for British Citizenship now. My Wife is on Family Visa. She is expecting baby in next few months. I am planning to send he back home for her delivery. If that is the case can my child apply for British CitizenShip from India? Or one of should be a British CitizenShip.

No, your child will have to apply for the same visa as your wife, settlement visa.

Child is only automatically British if born in the UK bevause you have ILR already.

Being born abroad before you are British doesnt give thw cjild any special status.

Can my child eligible for British CitizenShip if I am granted CitizenShip now(As I am eligible right away).

Citizenship takes a few months, you are only british once you have attended the ceremony.

If child is born after you have attended ceremony, then child is British by descent.

If born abroad, child will be born a British citizen if his/her date of birth is on or after the date of your citizenship ceremony.

As CR001 has advised already, if the child is born abroad before the date of your citizenship ceremony, s/he will follow the immigration path of the less-privileged parent (in this case, your wife), until both your wife and child acquire ILR.

Hi

Are there any new changes regarding new born child for indian parents in UK? One parent has ILR and other on dependent visa?

No change.

If child is born in the UK, the child will be automatically British.

If the child is born abroad, s/he will have the same UK immigration status as that of the less-privileged parent. The child will require ILR (which s/he will be eligible to get with the second parent) and can be registered as a British citizen when one or both parents have British citizenship and the child has ILR.
