Hi everyone, I am needing some advice/help regarding my British Citizenship. I have been in Scotland, UK since March 2011 and granted my ILR. My husband's seems to be reluctant to apply for my citizenship as our relationship becomes sour. He's become controlling (or maybe he is before but I just didn't noticed until now) to me. If I want to be separated from him, can I still apply for my Citizenship? If so, how can I do it on my own and what are the requirements and fees involve? Aside from that, I know his passport is needed....how can acquire that cos I'm sure he won't let me have it? And he also had our Marriage Certificate? Please really need your advice.

Your application for citizenship is completely separate to your husband. There is no 'dependent citizenship' concept or application.

You apply on form AN, pay the fee of £1,287

You can apply in your own right based on 5 years residence.

But the problem is? his Passport and our Marriage Certificate. I don't know how cos I am defo sure, he won't let me barrow it. He can be very difficult as he can be.

You don't need it if you apply based on 5 years residence and in your own right. You can provide an explanation in the 'additional information' page.

I just need some guidance on this matter. I would be grateful if someone can. Aside from extortion fee I have to pay, I don't want to disappoint myself again after given up everything what I have in my country and leaving my family and friends over there was a massive steps for me.

You are welcome. Feel free to ask any question you might have in this topic.

For info, as you hold Indefinite Leave to Remain, you are no longer a dependent on your spouse for immigration purposes. You are free to do whatever you want and can claim benefits if you need to.

Talking on benefits, aside from health care I didn't claimed anything. I have no idea what he'd claim?

As others have said- you may be eligible under the 5 year rule which does not require anything related to your husband's status. When did you receive your ILR?

You should always have a copy of your marriage certificate for your own purposes. Can you order your own copy from the authority in whatever country the marriage took place. Also- reading between the lines- if there is any chance of an acrimonious split you may want to keep your own documents such as passport, ILR evidence in a safe place (trusted friend, etc.) and be careful about losing money or incurring debt from joint bank accounts. You could contact a local women's shelter- even if you don't need to take refuge right now, they should be able to talk you through these issues in more detail and give you some options.

Thank you. I think I was granted my ILR 2012/2013. I don't have a copy of our marriage certificate or any important docs. cos he said he can keep it safe. I finding it hard to ask for copies on anything as I will be questioned on what purposes do I need it for and so on. I'm on difficulties atm cos of his controlling manner and gets angry on simple things. There comes to the point that I thought to end up my life as I failed myself cos marriage is so important in our culture way back home and I can't face my family.
