Dear Experts,

Need your help and suggestion on Citizenship/British passport

My husband hold ILR (Route Tier 2 ICT – 5 years stay in UK) and currently applied for Naturalisation and waiting for decision, but myself and my other child are still with PBS dependent visa as because i had a gap of 1 year in UK visa due to first child birth in India.

I am now pregnant and decided to give birth to 2nd child in UK and due date is early 2018. Can u please advise on the below

1) What would be the state of new born baby in UK? Is he or she can directly apply for British passport by having said that one of the parent hold ILR?
2) After new born baby British passport, What would be state of mother and other kid as we are currently in dependent visa?

It would be great if u could through some light on this.

Child would be automatically British and can apply for passport directly.

Same as your current visa. Why do you think your status changes??

What is your full immigration history and visa start/end dates and visa types?

There is no absence limit for PBS dependents so this gap would have been irrelevant for ILR.

In regards to ur query on my Visa.

Myself entered in UK with visa type as Tier 2 partner valid from 14th Feb 2011 till Jan 2013, Port of first entry was 12 Mar 2011 and due to pregnancy i traveled to India on 13 Sep 2011. Again my husband processed the dependent visa with type "Tier 2 ICT staff Partner valid from 26th Nov 2013 till 14th Feb 2015 and my port of entry was 7th March 2014 and continued to stay in UK with required visa extension and still in UK and my current visa end date is Oct 2017 and planning to have one more extension as PBS dependent.

Please advise and let me know to have one more extension and will be eligible in Feb 2019 for ILR .

Correct yes, you can apply for ILR no sooner than within 28 days before 7th March 2019. When you apply for an extension now in October, it will be a 3 year extension.
