Hi sorry but I have a question I’m 25 weeks pregnant and I want to apply for a permanent resident card for my self because I hurt that if I have a resident card and I am lived in the uk more than 5 years know I was studying and I’m working know ..afther when I have my resident card my baby will be automatically be come a British citizen is that right?
If yes how long I have to wait to have my resident card if I send the form on Monday ?

If you are a EU citizen and you get the "permanent residence card" (not just residence card, you need the one that says permanent on it) before giving birth, then your baby will be British and you can apply for a passport for the baby.

To get the PR card now takes about 1-2 months and you can apply on-line here: https://visas-immigration.service.gov.uk/product/eea-pr

And if I will get the card after what I have to do I just need to file the form for my baby to have the British passport ?

It says there on the link how much you have to pay. Have you read any of it?

Yes, if you do get the PR card then you can apply for a passport for the baby directly.

twgal, this is somewhat inaccurate.

If she obtains the PR certificate, with it she should obtain a letter that mentions the date from which permanent residence right was acquired. This is a date, always before the issue date of the PR document and represents the date that 5 continuous years were reached exercising treaty rights. This could be a long time ago.

Hence, if you have completed any 5 year continuous residence exercising treaty rights per EEA(PR) requirements, before the baby is born, the baby will be automatically British even if your certificate is issued after the birth

A decision letter with your Case ID will arrive and mention the date from which you have bestowed the permanent residency status. This is the one that has to be before the birth date of your baby.

From what you said you should already be eligible. Hence you have to wait for your permanent residency status to be "certified" (different wording compared to immigration status "appoved"). Once you have the card and the letter you can use them as proof to apply for a first child British passport for your child.

I'm not a solicitor, this is my simple user opinion on an Internet forum. People shouldn't rely solely on information expressed on Internet forums, they should check the official info.

I stand by my opinion though - if she gets the PR card in the next couple of months and gives birth after receiving that card - then the baby will be born British. The PR card will simply confirm that she obtained the PR status at some point in the past.

I'm not saying there aren't other possibilities (like applying for a PR card after the birth of the baby but with a qualifying period that ends prior to the birth of the baby). There are other routes, but the one I posted is a viable one, assuming the mother actually qualifies for PR status and makes a successful PR card application.

As the OP is 4 moths pregnant, she may well not get the card before the baby is born. That is why the clarification was appropriate.

No problem mate, I am not a solicitor, nor do I tend to criticise either.

I have obtained EEA-PR myself and there is a letter explaining this clearly.

Qualifying period end date matters, not issue/approval date of the application for cerfication of permanent residence status (already held).
